Vaping use is illegal in Mexico by decree in DOF
Oaxaca.- As of January 17, 2025, a decree was published in the Official Gazette of the Federation (DOF) that prohibits the use and commercialization of vapes in Mexico. This reform seeks to protect public health, especially for young people, and establishes a year for states to harmonize their laws in this regard. The ban includes the production, distribution, and sale of these devices, as well as the illicit use of fentanyl and other unauthorized synthetic drugs. Penalties for using vapes in Mexico include: Fines of up to 185,000 pesos for smoking or possessing vapes on public roads.
