China-based Shenzhen IVPS, the parent company of Smok-branded vaping devices, has appealed to the U.S. Food and Drug Administration for marketing rejection orders for six of the company's open-system vaping devices. IVPS appealed to the U.S. Court of Appeals for the Fifth Circuit in New Orleans, Louisiana, and filed a lawsuit with a distributor of Smok products in Dallas, Texas, who was denied marketing.
