Tobacco companies appeal marketing denial orders
China-based Shenzhen IVPS, the parent company of Smok-branded vaping devices, has appealed to the U.S. Food and Drug Administration for marketing rejection orders for six of the company's open-system vaping devices. IVPS appealed to the U.S. Court of Appeals for the Fifth Circuit in New Orleans, Louisiana, and filed a lawsuit with a distributor of Smok products in Dallas, Texas, who was denied marketing. The FDA alleges that it has issued marketing denial orders for premarket tobacco product applications (PMTAs) for Smok products because the applications "failed to provide sufficient data to characterize ingredient delivery, product stability, and product abuse liability."
